Ketentuan penggunaan komersial

- Jika Anda—Klien—ingin memesan jasa kami untuk penggunaan Komersial, total harga jasa, serta royalti lainnya, akan disepakati dimuka.
- Anda dapat menggunakan hasil model 3D untuk tujuan komersial (contoh: streaming untuk pendapatan), tetapi tidak dapat distribusikan kembali (menjual kembali atau membagikannya ke publik secara fisik maupun digital, dengan yang dimaksud seperti; Menjual 3D model secara daring maupun luring, dijadikan merchandise fisik dengan maksud memberikan keuntungan finansial) tanpa Izin Mirukulab.
- Kasus berikut dianggap penggunaan komersial: Mereproduksi dan menjual karya seni, publik atau pribadi, kasus di mana anda menerima keuntungan dari media/platform tempat anda memposting karya kami, (misalnya Patreon, YouTube, Twitch, situs pribadi, kartu nama dll).
- Kami tetap memiliki hak copyright atas hasil karya kami, dan anda sebagai klien tidak berhak mengklaim hasil karya kami atas nama anda.
- Kami berhak memposting karya yang telah jadi sebagai portofolio kami maupun menjadikannya sebagai bahan promosi kami dengan alasan apa pun.

Ketentuan Pembelian Full Copyright

- Jika Anda—Klien—ingin memesan jasa kami untuk penggunaan komersial sekaligus membeli hak copyright hasil karya kami, total harga jasa, serta royalti lainnya, akan disepakati di muka.
- Bila Anda membeli Hak Copyright 100%, maka kami sebagai Mirukulab tidak berhak untuk memposting hasil karya kami dalam bentuk apapun maupun memasukannya ke dalam portofolio kami.
- Klien berhak untuk menggunakannya untuk tujuan komersial, dalam kasus ini meliputi : mendistribusikan, mereproduksi, hingga menjualnya kembali hasil karya kami sebagai hak milik klien.

NDA – Privacy Request

- Jika anda—Klien—meminta kerahasiaan, itu harus dinyatakan sebelum proses pembayaran.
- Kami berhak untuk membebankan biaya jika klien meminta hal tersebut.
- Privacy Request mensyaratkan bahwa kami tidak berhak untuk mempublikasikan WIP (work in progress) apapun di social media, dan juga tidak berhak untuk melakukan proses pembuatan secara streaming di tempat manapun.
- Namun juga, ini berarti anda harus menahan diri untuk tidak mempublikasikan proses pembuatannya.
- Ini cukup penting bila mana anda seorang Vtuber dan ingin kami—Mirukulab—tetap diam hingga proses debut anda
- NDA fee bervariasi. Dimulai dari +10% dari total harga, namun bisa saja berbeda. Semakin besar komisi, semakin besar pula fee yang harus dibayarkan.

Commission

Ordering

- Anda diharapkan untuk mengontak kami terlebih dahulu.
- Anda setelahnya akan mendapat balasan dari kami untuk mendiskusikan detail dan konfirmasi slot anda kapan akan dikerjakan.
- Jika karakter Anda sangat detail, kami berhak membebankan biaya tambahan untuk menyertakan detail ini. Biaya ini akan dinyatakan sebelum transaksi, dan Anda berhak untuk melakukan perubahan pada permintaan komisi Anda (misalnya mengubah karakter, menyetujui perubahan desain yang disederhanakan) sebelum transaksi selesai.
- Harap deskripsi permintaan Anda secara padat dan jelas sehingga mudah dimengerti
- Setiap email, pesan pribadi, dan komentar yang Anda kirim harus dalam bahasa berikut: Inggris atau Indonesia.
- Sebelum melakukan transaksi apa pun, anda diharuskan menunggu balasan agar kami dapat mendiskusikan detailnya.
- Setelah semuanya diproses dan dikonfirmasi, kami akan mengirimkan faktur/invoice kepada Anda. Anda perlu mengkonfirmasi pembayaran dengan kami sebelum kami memulai pesanan Anda.

Payment

- Kami menerima pembayaran 50-50 atau pembayaran penuh dimuka
- Kami hanya menerima pembayaran melalui Paypal dan Wise untuk mata uang USD. BCA untuk mata uang IDR. Jika mata uang anda selain itu, anda diharuskan untuk mengkonversikan menjadi mata uang IDR atau USD
- Setelah DP terkirim, kami akan membuat karakater. Perlu diketahui bahwa yang kami kerjakan dahulu adalah yang pertama mengirimkan pembayaran.
- Jika anda telah melakukan pembayaran namun kami telah/sedang mengerjakan komisi lain, maka komisi anda akan masuk ke dalam antrian.
- Jangan mengirimkan pembayaran sebelum kami menerima komisi anda hingga meminta anda untuk melanjutkan pembayaran.
- Jika pembayaran tidak dilakukan dalam waktu 48 jam setelah kami mengirimkan faktur/invoice, maka komisi anda akan dibatalkan. Jika anda berulang kali melakukan hal ini dan gagal membayar, maka akan dilakukan blacklist oleh kami.

Refund

- Apabila anda ingin membatalkan komisi setelah melakukan DP dan sebelum kami mengerjakan project, maka anda akan mendapatkan refund 100% - (biaya transfer+biaya kerja komunikasi)
- Apabila anda membatalkan komisi setelah kami mengerjakan project, maka anda tidak akan mendapatkan refund sama sekali, namun anda tidak akan dibebankan biaya lebih lanjut jika anda membatalkan project.
- Jika kami yang membatalkan project, maka anda akan mendapatkan Refund 100%

Chargeback

- Anda tidak diperkenankan untuk melakukan chargeback dengan alasan apapun.
- Jika alasannya dikarenakan akun Paypal anda mengalami malfungsi, dan melakukan request refund tanpa anda ketahui, anda harus segera kontak kami untuk menyelesaikan masalah tersebut.
- Anda wajib menghubungi kami jika anda ingin membatalkan komisi.
- Melakukan chargeback tanpa menghubungi kami untuk membatalkan/refund komisi akan mengakibatkan anda akan di blacklist secara langsung oleh kami, termasuk email, serta siapapun yang berbagi akun dengan anda, termasuk akun sampingan anda.

Queue / Jadwal / Waktu Pengerjaan / Deadline

- Anda—Klien--berhak untuk menetapkan deadline atas komisi anda.
- Deadline wajib anda sebutkan sebelum melakukan pembayaran.
- Kami dapat menolak project jika waktu yang diberikan terlalu singkat.
- Jika anda tidak menetapkan deadline pada kami, maka kami akan mengerjakan komisi anda setidaknya minimal 3 minggu setelah anda melakukan pembayaran.
- Selama pengerjaan, kami akan memberikan update progress setidaknya minimal 4 hari sekali.
- Kami akan mengerjakan yang pertama kali mengirimkan pembayaran.
- Jika anda telah melakukan pembayaran namun kami telah/sedang mengerjakan komisi lain, maka komisi anda akan masuk ke dalam antrian.
- Jika ada delay dari pengerjaan, maka anda berhak mendapatkan informasi dari kami.

Rush Fee

- Jika anda mengingkan hasil dengan waktu yang lebih singkat, maka kami akan membebankan biaya setidaknya +25% dari harga total komisi. Biaya akan relatif berbeda tergantung dari berapa waktu yang dipotong.

Revisi

- Jika pengerjaan masih dalam tahap modelling, maka anda masih berhak untuk merevisi bentuk tubuh dari 3D model yang sedang dikerjakan.
- Jika pengerjaan telah sampai pada tahap Rigging dan shapekey/blendshape, maka anda tidak berhak untuk merevisi bentuk tubuh dari 3D model yang sedang dikerjakan. Namun anda berhak untuk merevisi Rigging dari karakter yang sedang dikerjakan bila gerakan nya tidak sesuai yang anda inginkan.
- Jika pengerjaan telah sampai pada tahap Texturing, maka anda hanya berhak untuk merevisi texture bila tidak sesuai yang anda inginkan.
- Jika pengerjaan karakter telah selesai, maka anda sudah tidak berhak untuk merevisi karakter tersebut. Pastikan untuk memperhatikan baik baik apa yang kami kirimkan kepada anda sehingga tidak ada info yang tertinggal.
- Jika Pengerjaan karakter telah selesai, maka kami akan melanjutkan ke tahap tracking model. Di sini anda hanya dapat revisi tracking setidaknya 3 kali hingga karakter telah ter tracking sesuai keinginan anda.

Final Product

- Kami akan mengikuti referensi yang telah diberikan semaksimal mungkin. Namun tidak akan menutup kemungkinan jika sedikit perbedaan antara final product dengan desain yang ada. Terutama apabila banyak inkonsistensi pada desain karakter dari berbagai sudut referensi.
- File yang akan kami berikan kepada anda akan berupa FBX, blend, or VRM file tergantung dari apa yang anda pesan.
- Kami akan mengirimkan file setelah anda melunasi pembayaran. Apabila anda tidak melunasi pembayaran akhir setelah H+7 dari hasil akhir produk, maka akan dilakukan blacklist secara langsung
- Setiap komentar kasar, tidak pantas, menghasut, destruktif akan mengakibatkan blacklist pada anda
- Klien dapat memberikan kritik, saran, maupun komentar terhadap pelayanan kami serta hasil produk dari jasa kami.

Disclaimer

- By purchasing our Services, you-the client-automatically agree to the following terms.
- Please read these fully and carefully. We will refuse your commission if you do not agree to these terms.
- If you are not comfortable with our terms of service and/or are not willing to agree to these terms, you should not request our services.
- If you have any questions, please contact us.

User Agreement

- By purchasing our services, you agree that you have read and accepted all the terms described herein.
- If you violate any of these terms, you will be added to our blacklist.
- We reserve the right to refuse any project or client for any reason.
- Clients who have booked our services and/or accepted work before these Terms come into effect are still bound by its contents.
- You are not permitted to upload our work on any site/place that is intended to showcase your own work.

Commercial usage terms

- If you-the Client-want to book our services for Commercial use, the total price of services, as well as other royalties, will be agreed upon upfront.
- You may use the 3D model output for commercial purposes (e.g. streaming for revenue), but not redistribution (reselling or sharing it with the public physically or digitally, with such means as; Selling the 3D model online or offline, turning it into physical merchandise with the intention of providing financial gain) without Mirukulab's permission.
- The following cases are considered commercial use: Reproducing and selling artwork, public or private, cases where you receive profit from the media/platform where you post our work, (e.g. Patreon, YouTube, Twitch, personal sites, business cards etc).
- We retain the copyright of our work, and you as a client have no right to claim our work on your behalf.
- We reserve the right to post the finished work as our portfolio or to use it as our promotional material for any reason.

Full Copyright Purchase Conditions

- If you-Client-want to book our services for commercial use as well as purchase the copyright rights of our work, the total price of services, as well as other royalties, will be agreed upon in advance.
- If you purchase 100% Copyright Rights, then we as Mirukulab do not have the right to post our work in any form or include it in our portfolio.
- The client has the right to use it for commercial purposes, in this case includes: distributing, reproducing, and reselling our work as client's property.

Commission

- You are expected to contact us first.
- You will then hear back from us to discuss the details and confirm when your slot will be worked on.
- If your character is highly detailed, we reserve the right to charge an additional fee to include these details. This fee will be stated prior to the transaction, and you reserve the right to make changes to your commission request (e.g. changing characters, agreeing to simplified design changes) before the transaction is completed.
- Please describe your request concisely and clearly so that it is easy to understand.
- Any emails, private messages and comments you send must be in the following languages: English or Indonesian.
- Before making any transaction, you are required to wait for a reply so that we can discuss the details.
- Once everything is processed and confirmed, we will send you an invoice. You need to confirm the payment with us before we start your order.

Payment

- We accept 50-50 payment or full payment upfront.
- We only accept payment via Paypal and Wise for USD currency. BCA for IDR currency. If your currency is other than that, you are required to convert to IDR or USD currency.
- After the DP is sent, we will create the character. Please note that we will work on the first one to send the payment.
- If you have made a payment but we have/are working on another commission, then your commission will go into the queue.
- Do not submit payment until we receive your commission and ask you to proceed with payment.
- If payment is not made within 48 hours of us sending you an invoice, your commission will be canceled. If you repeatedly do this and fail to pay, you will be blacklisted by us.

Refund

- If you want to cancel the commission after making a down payment and before we work on the project, then you will get a 100% refund - (transfer fee + communication work fee).
- If you cancel the commission after we work on the project, then you will not get a refund at all, but you will not be charged further fees if you cancel the project.
- If we cancel the project, then you will get a 100% Refund.

Chargeback

- You are not allowed to chargeback for any reason.
- If the reason is due to your Paypal account malfunctioning, and requesting a refund without your knowledge, you must contact us immediately to resolve the issue.
- You must contact us if you wish to cancel a commission.
- Making a chargeback without contacting us to cancel/refund the commission will result in you being blacklisted by us immediately, including your email, as well as anyone who shares an account with you, including your side accounts.

Queue / Schedule / Working Time / Deadline

- You-the Client-have the right to set a deadline for your commission.
- Deadline must be mentioned before making payment.
- We may reject the project if the time given is too short.
- If you do not set a deadline for us, then we will work on your commission at least at least 3 weeks after you make payment.
- During the process, we will provide progress updates at least once every 4 days.
- We will work on the first to send payment.
- If you have made a payment but we have/are working on another commission, then your commission will go into the queue.
- If there is a delay from the work, then you have the right to get information from us.

Rush Fee

- If you want results in less time, then we will charge at least +25% of the total commission price. The fee will be relatively different depending on how much time is deducted.

Revision

- If the work is still in the modeling stage, then you still have the right to revise the body shape of the 3D model being worked on.
- If the work has reached the Rigging and shapekey/blendshape stages, then you do not have the right to revise the body shape of the 3D model being worked on. But you have the right to revise the Rigging of the character being worked on if the movement is not what you want.
- If the work has reached the Texturing stage, then you only have the right to revise the texture if it is not what you want.
- If the work on the character has been completed, then you have no right to revise the character. Be sure to pay close attention to what we send you so that no info is left out.
- If the character work has been completed, then we will proceed to the model tracking stage. Here you can only revise the tracking at least 3 times until the character has been tracked to your preference.

Final Product

- We will follow the references that have been given as much as possible. However, it is possible that there will be slight differences between the final product and the existing design. Especially if there are many inconsistencies in the character design from various reference angles.
- The files we will give you will be FBX, blend, or VRM files depending on what you order.
- We will send you the files after you make the final payment. If you do not make the final payment after H+7 of the final product, it will be blacklisted immediately.
- Any rude, inappropriate, inciting, destructive comments will result in your blacklist.
- Clients can provide criticism, suggestions, or comments on our services and product results from our services.
